This website, located at www.parolive.com (the “Site”), is operated by Par Olive Pty Ltd in Australia and Par Olive Holdings in the United States (collectively, “Par Olive,” “we,” “us,” or “our”).

Par Olive offers this Site, including all information, tools, and services available from the Site, to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here (“Terms of Service” or “Terms”).

By visiting our Site, using any part of the Site, and/or purchasing something from us, you agree to be bound by these Terms. These Terms apply to all Site users, including without limitation browsers, vendors, customers, merchants, and/or contributors of content.

If you do not agree to all of these Terms, you must not use or access the Site.

Our store is hosted on Shopify, which provides the e-commerce platform enabling us to sell our products and services to you.

We may update these Terms at any time by posting changes on the Site. Your continued use of the Site constitutes acceptance of those changes.

2. GENERAL CONDITIONS

By agreeing to these Terms, you confirm that:
(a) You are at least the age of majority in your state, province, or country of residence, or you have given us your consent to allow any of your minor dependents to use the Site.
(b) You will not use our products for any unlawful purpose or in violation of any applicable laws.
(c) You will not transmit any worms, viruses, or malicious code.

4. LICENSE & PERMITTED USES

We grant you a limited, non-exclusive, non-transferable licence to access and use the Site for personal, non-commercial purposes, subject to these Terms. Any unauthorised use will result in termination of this licence.

5. ACCURACY OF INFORMATION

We strive to ensure that the information on our Site is accurate, but we do not guarantee that product descriptions, pricing, or other content are error-free, complete, or current.

6. PRODUCTS & SERVICES

Products may be available exclusively online and in limited quantities. They are subject to return or exchange according to our Return Policy.

We reserve the right to:

Limit product quantities
Refuse or cancel orders at our sole discretion
Discontinue any product at any time

Currency:

For Australian customers, prices are listed in AUD.
For US and other international customers, prices are listed in USD unless stated otherwise.

International Orders: Customs duties, taxes, and fees may apply and are the responsibility of the customer as the importer of record.

7. SUBSCRIPTIONS

(a) Subscription Terms

We offer subscription plans (each, a “Subscription”) for regular shipments of selected Par Olive products. Details — including delivery frequency, term length, and pricing — are shown on our Subscription Details Page, which is incorporated into these Terms.

By purchasing a Subscription, you agree to receive recurring shipments of your selected products at the frequency you choose, unless paused or cancelled in accordance with these Terms.

(b) Subscription Fee & Billing

If you purchase a Subscription, you will be charged the applicable Subscription fee displayed on the Subscription Details Page, plus any applicable taxes and shipping (“Subscription Fee”), at the start of your Subscription and on each recurring billing date thereafter, according to your selected delivery schedule.

BY PURCHASING A SUBSCRIPTION, YOU AUTHORISE PAR OLIVE (THROUGH SHOPIFY OR OUR THIRD-PARTY PAYMENT PROCESSOR) TO INITIATE AUTOMATIC, RECURRING, NON-REFUNDABLE PAYMENTS UNTIL YOU CANCEL IN ACCORDANCE WITH THESE TERMS.

Your Subscription Fee will be billed automatically to your saved payment method until your Subscription paused or is cancelled.
We may change the Subscription Fee or available Subscription options from time to time, in accordance with applicable law. Any changes will be communicated in advance and will not affect any Subscription period you have already paid for.
By agreeing to these Terms and purchasing a Subscription, you acknowledge and accept that your Subscription has recurring payment features and that you are responsible for all charges prior to cancellation.

(c) Cancellation

(i) General
You may cancel your Subscription at any time. Cancellations take effect at the end of your current billing period. This means you will continue to receive and be charged for any shipments scheduled before the cancellation takes effect.

Subject to applicable law:

Subscription Fees already paid for the current billing period are non-refundable.
You are responsible for all charges for the current billing period at the time of cancellation.

(ii) Approved Cancellation Methods

A. Through Your Par Olive Account:

Log in to your account.
Go to the “Subscriptions” section.
Click “Cancel Subscription” and follow the prompts.

B. Via Email:
Send an email to [Insert Email] from the same email address linked to your account, with the subject line “Subscription Cancellation Request”. Include:

Your full name
The email linked to your Par Olive account
A clear request to cancel your subscription

We will confirm your cancellation by email once it has been processed.

8. BILLING & ACCOUNT INFORMATION

You agree to provide current, complete, and accurate purchase and account information for all transactions on our Site, including subscriptions. You must promptly update your details so we can complete transactions and contact you as needed.

9. OPTIONAL TOOLS & THIRD-PARTY LINKS

We may provide access to third-party tools or links to other websites. We do not control these services and assume no responsibility for their content, accuracy, or policies. Your use of such tools or links is at your own risk.

10. USER SUBMISSIONS

If you send us comments, reviews, or other materials, you grant us a royalty-free, perpetual licence to use, reproduce, and publish such content in any medium.

11. PROHIBITED USES

You must not use the Site or its content for:

Illegal purposes
Violating intellectual property rights
Harassment, abuse, or discrimination
Uploading malicious code
Collecting personal data without consent
Fraudulent activity

12. SECURITY

13. DISCLAIMER OF WARRANTIES

For Australian customers: Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot be excluded, restricted, or modified.

For US customers: To the fullest extent permitted by law, Par Olive disclaims all implied warranties of merchantability and fitness for a particular purpose. In no event shall Par Olive be liable for indirect, incidental, or consequential damages, and our total liability shall not exceed the amount paid by you for the product or $100, whichever is greater.

15. INDEMNIFICATION

You agree to indemnify and hold harmless Par Olive from any claims or expenses arising from your breach of these Terms or your violation of any law or third-party rights.

16. GOVERNING LAW & JURISDICTION

If you are located in Australia: These Terms are governed by the laws of New South Wales, Australia, and you submit to the exclusive jurisdiction of the courts of New South Wales.

If you are located in the United States: These Terms are governed by the laws of the State of California, without regard to conflict of law principles, and you submit to the exclusive jurisdiction of the courts located in Los Angeles County, California.
